Paternity Suits

The word paternity refers to the father of a child. Paternity can be both legal and biological.

If a child is born within wedlock Texas law presumes that the man is the legal father unless otherwise established in a separate paternity suit.

If a child is born outside of wedlock then there is no legal father until paternity has been established.

Paternity can be established by filing a paternity suit. There is no time limit for filing a paternity suit but if the child is a legal adult he or she must file the suit.

A court may order scientifically accepted paternity testing. By law, the court may order that the mother, alleged father, and child to submit blood, body fluid or tissue samples in order to establish paternity.

A presumption of paternity can be rebutted by filing a suit to adjudicate parentage.
