Traumatic Brain Injury in Texas Law

Traumatic brain injuries can affect a person's ability to think, feel and communicate normally. A traumatic brain injury can have life altering consequences.

There are two types of traumatic brain injuries: (1) closed and (2) penetrating. A closed brain injury is one that is caused by the movement of the brain within the skull as a result from impact. A penetrating brain injury results from an external object entering the skull such as bullet from a firearm or other foreign object.

Injuries to different areas of the brain can produce different types of problems. For example, injury to the brain stem and cause difficulty breathing, sleeping or even swallowing food. It affects your heart rate as well as your reflexes related to your hearing, as well as regulation of certain functions of the nervous system.

An injury to the cerebellum can damage your balance and equilibrium affecting coordination of skilled motor response. this type of can causes dizziness, loss of ability to coordinate movements such as walking for reaching for objects, slurred speech and tremors.

Your frontal lobe is responsible for your emotional and environmental conscious activity. It is also responsible for your memory, motor functions and basic behavioral patterns. Damage to the frontal lobe can result in extreme social behavior dysfunction, communication difficulties, mood changes, loss of basic problem solving skills or even paralysis.

The occipital lobe controls your vision. If this area of your brain is damaged you may have difficulty identifying colors, reading or writing, recognizing objects, or even hallucinations.

The parietal lobe of our brain coordinates our visual attention with touch. injury to this part of the brain can result in difficulty drawing, differentiating between shapes, as well as loss of eye-hand coordination and spatial perception.

Finally, the temporal lobe is responsible for hearing and memory. Damage to this part of the brain can result in bizarre behavior, as well as the inability to recognize faces and/or objects. Substantial memory loss can also occur.

A person who has suffered a traumatic brain injury as a result of the negligence may be entitled to compensation including recovering costs of medical bills, lost wages, future medical care, even loss of future earning capacity. they are also entitled to compensation for pain, disfigurement and impairment.

Under Texas law parents or guardians of student athletes must sign a form acknowledging the receipt in recognition of information explaining concussion prevention, symptoms and treatment resulting from participation in certain athletic activities.
