(a) Each insurance policy delivered or issued for delivery in this state shall include with the policy a brief written notice that includes: (9431)

(1) a suggested procedure to be followed by a policyholder with a dispute concerning the policyholder's claim or premium; (9432)

(2) the department's name and address; and (9433)

(3) the department's toll-free telephone number maintained under Subchapter B. (9434)

(b) The commissioner shall adopt appropriate wording for the notice. (9435)

(1) information collected or maintained by the department relating to the number and disposition of complaints received against an insurer that are justified, verified as accurate, and documented as valid, expressed as a percentage of the total number of insurance policies written by the insurer and in force on December 31 of the preceding year; (9445)

(2) the rating of an insurer, if any, as published by a nationally recognized rating organization; (9446)

(3) the kinds of coverage available to a consumer through any insurer writing insurance in this state; (9447)

(4) an insurer's admitted assets-to-liabilities ratio; and (9448)

(5) other appropriate information collected and maintained by the department. (9449)

(a) Except as provided by Subsection (b), this subchapter applies to a health maintenance organization authorized to engage in the business of a health maintenance organization in this state or an insurer authorized to engage in the business of insurance in this state, including: (9467)

(1) a capital stock insurance company; (9468)

(2) a mutual insurance company; (9469)

(3) a title insurance company; (9470)

(4) a fraternal benefit society; (9471)

(5) a local mutual aid association; (9472)

(6) a statewide mutual assessment company; (9473)

(7) a county mutual insurance company; (9474)

(8) a Lloyd's plan; (9475)

(9) a reciprocal or interinsurance exchange; (9476)

(10) a stipulated premium company; (9477)

(11) a group hospital service corporation; and (9478)

(12) a risk retention group. (9479)

(b) This subchapter does not apply to a health maintenance organization or insurer: (9480)

(1) that has gross initial premium receipts collected in this state of less than $2 million each year; or (9481)

(2) with regard to fidelity, surety, or guaranty bonds. (9482)

A health maintenance organization or insurer shall maintain a toll-free telephone number to: (9485)

(1) provide information concerning evidences of coverage or policies issued by the health maintenance organization or insurer; and (9486)

(a) Each health maintenance organization or insurer that delivers, issues for delivery, or renews an evidence of coverage or insurance policy in this state shall print on the evidence of coverage or policy the health maintenance organization's or insurer's toll-free telephone number. (9490)

(b) The commissioner may adopt rules governing the manner in which the toll-free telephone number appears on the evidence of coverage or insurance policy. (9491)

This subchapter applies to any legal entity engaged in the business of insurance in this state, including: (9495)

Sec. 521.152. REGISTRY; INTERNET POSTING. (9512)(1-click HTML)

(a) The commissioner shall establish a registry of each legal entity engaged in the business of insurance in this state that, formally or informally, has entered into an agreement with the department: (9513)

(1) that disposes of allegations of race-based pricing; and (9514)

(2) under which all or part of the relief agreed on to make insureds whole includes a claims-made offer that remains in place and has not otherwise expired under the terms of the agreement. (9515)

(b) The registry must be prominently published on the department's Internet website, and must: (9516)

(1) identify: (9517)

(A) each insurance company that has entered into an agreement described by Subsection (a); and (9518)

(B) the eligibility and terms of the insurance company's claims-made offer; and (9519)

(2) include: (9520)

(A) a claim form; and (9521)

(B) links to the Internet website of the insurance company that is administrating the claims-made offer. (9522)

Sec. 521.153. PRESERVATION OF CERTAIN RECORDS REGARDING RACE-BASED PRICING. (9524)(1-click HTML)

(a) Notwithstanding Chapter 441, Government Code, the department shall preserve all examinations, exhibits to examinations, and other relevant documents regarding race-based pricing that the department has gathered or created with respect to a race-based pricing investigation that is completed or ongoing on September 1, 2009, other than those for which an attorney-client or attorney work product privilege can be claimed, until the time that those documents are eligible for delivery under Subsection (b). (b) On the completion of the department's race-based pricing investigation, but not later than January 15, 2011, the department shall deliver the records identified under Subsection (a) or copies of those records to the state archivist. (9526)

(c) The state archives shall: (9527)

(1) using best efforts, preserve and catalogue the records identified under Subsection (a); and (9528)

(2) make the records available to the public as soon as appropriate, but not later than January 15, 2015. (9529)

CHAPTER 522. CONSUMER INFORMATION IN SPANISH (9531)(1-click HTML)
Sec. 522.001. INFORMATIONAL SHEET FOR TEXAS PERSONAL AUTOMOBILE POLICIES. (9532)(1-click HTML)

(a) The commissioner shall develop or adopt an informational sheet in the Spanish language to provide a general explanation of the terms most commonly used in the Texas personal automobile insurance policy. The department shall make the informational sheet available to the public. (9533)

(b) The informational sheet is intended to provide only a general explanation of insurance terms used in the Texas personal automobile insurance policy and is not intended to alter any rights, obligations, or responsibilities of the contracting parties. All other applicable laws, including provisions of this code, apply regardless of whether an informational sheet is used. (9534)

(c) The informational sheet must include a disclaimer in the Spanish language, prominently printed in 10-point boldfaced type at the top of the informational sheet, that contains the following: (9535)

"This document is for informational purposes only and is not intended to alter or replace the insurance policy. Additionally, this informational sheet is not intended to fully set out your rights and obligations or the rights and obligations of the insurer. If you have questions about your insurance, you should consult your insurance agent, the insurer, or the language of the insurance policy." (9536)

CHAPTER 524. HEALTH COVERAGE AWARENESS AND EDUCATION PROGRAM (9539)

(a) The department shall develop and implement a health coverage public awareness and education program that complies with this chapter. The program must: (9541)

(1) increase public awareness of health coverage options available in this state; (9542)

(2) educate the public on the value of health coverage; and (9543)

(3) provide information on health coverage options, including health savings accounts and compatible high deductible health benefit plans. (9544)

(b) The department may include information about specific health coverage issuers but may not favor or endorse one particular issuer over another. (9545)

(a) The commissioner shall appoint a task force to make recommendations regarding the health coverage public awareness and education program. The task force is composed of: (9555)

(1) one representative from each of the following groups or entities: (9556)

(A) health benefit coverage consumers; (9557)

(B) small employers; (9558)

(C) employers generally; (9559)

(D) insurance agents; (9560)

(E) the office of public insurance counsel; (9561)

(F) the Texas Health Insurance Risk Pool; (9562)

(G) physicians; (9563)

(H) advanced practice nurses; (9564)

(I) hospital trade associations; and (9565)

(J) medical units of institutions of higher education; (9566)

(2) a representative of the Health and Human Services Commission responsible for programs under Medicaid and the children's health insurance program; and (9567)

(3) one or more representatives of health benefit plan issuers. (9568)

(b) The department shall consult the task force regarding the content for the public service announcements, Internet website, and educational materials required by this chapter. The commissioner has authority to make final decisions as to what the program's materials will contain. (9569)

The department may accept gifts and grants from any party, including a health benefit plan issuer or a foundation associated with a health benefit plan issuer, to assist with funding the program. The department shall adopt rules governing acceptance of donations that are consistent with Chapter 575, Government Code. Before adopting rules under this subsection, the department shall: (9572)

(1) submit the proposed rules to the Texas Ethics Commission for review; and (9573)

(2) consider the commission's recommendations regarding the regulations. (9574)

(c) The division may produce a newsletter to provide updated information about health coverage to subscribers who elect to receive the newsletter. The division may: (9617)

(1) produce a newsletter under this subsection for small employers, for individuals, or for other purchasers of health coverage; (9618)

(2) distribute the newsletter on a monthly, quarterly, or other basis; and (9619)

(3) distribute the newsletter as a printed document or electronically. (9620)

(b) The Health and Human Services Commission, through its 2-1-1 telephone number for access to human services, may disseminate information regarding health insurance coverage provided to the commission by the department and may refer inquiries regarding health insurance coverage to the toll-free telephone hotline. The department may provide information to the Health and Human Services Commission as necessary to implement this subsection. (9625)

(A) provide step-by-step instructions for a small employer or single-employee business that is obtaining health coverage for the benefit of the employer or business and the employees of the business; and (9660)

(2) make department staff available to assist small employers and single-employee businesses that are obtaining health coverage as described by Subdivision (1). (9662)

The department may accept gifts and grants from any party, including a health benefit plan issuer or a foundation associated with a health benefit plan issuer, to assist with funding the program. The department shall adopt rules governing acceptance of donations that are consistent with Chapter 575, Government Code. Before adopting rules under this section, the department shall: (9677)

(1) submit the proposed rules to the Texas Ethics Commission for review; and (9678)

(2) consider the commission's recommendations regarding the regulations. (9679)

This chapter applies to: (9684)

(1) an insurer, as defined by Section 2301.051, writing personal automobile insurance or residential property insurance, as defined by Section 2301.051, in this state; (9685)

(2) the Texas Windstorm Insurance Association; (9686)

(3) the FAIR Plan Association; and (9687)

(4) the Texas Automobile Insurance Plan Association. (9688)

Sec. 525.002. DELIVERY OF INSURANCE POLICIES. (9690)(1-click HTML)

(a) Except as provided by Subsection (b), an insurer to whom this chapter applies shall deliver a policy issued by the insurer to the policyholder, or to the insurer's agent for delivery to the policyholder: (9691)

(1) not later than: (9692)

(A) the 30th day after the effective date of the policy if the policy term is more than 30 days; or (9693)

(B) the 10th day after the effective date of the policy if the policy term is more than 10 days and less than 31 days; or (9694)

(2) within the policy period for a policy with a term of 10 days or less. (9695)

(b) An insurer to whom this chapter applies shall deliver a policy renewed or amended by the insurer to the policyholder, or to the insurer's agent for delivery to the policyholder, not later than the 15th day after the date the insurer or insurer's agent receives a written request from the policyholder that the policy be delivered to the policyholder.
